1. Definitions

• "Duksaa," "we," "us," or "our" refers to Duksaa, its website, and mobile applications.
• "User," "you," or "your" refers to any individual or entity using Duksaa’s services.
• "Property" or "Accommodation" refers to hotels, hostels, or other lodging facilities listed on Duksaa.
• "Booking" refers to a reservation made through our platform.
• "Partner" refers to hotels, car companies, or accommodation providers listed on Duksaa.

2. Use of Duksaa Services

By using Duksaa, you confirm that you:

• Are at least 18 years old or have legal consent from a guardian.
• Provide accurate, complete, and truthful information.
• Will not use Duksaa for unlawful or fraudulent activities.
• Will comply with all local laws when booking accommodations.

We reserve the right to deny service, suspend, or terminate accounts if any fraudulent, abusive, or inappropriate behavior is detected.

3. Booking Process

• 3.1. Availability & Pricing

  • Prices and availability are set by partners and may change without notice.
  • Duksaa does not guarantee availability until booking confirmation is received.

• 3.2. Payment & Fees

  • You agree to pay all charges associated with your booking.
  • Duksaa may offer different payment methods (credit/debit cards, digital wallets, etc.).
  • 50% of your payment must be paid to book your stay or car.
  • Remaining 50% is to be paid at the Hotel or Car Company.
  • Taxes and additional fees may apply as per local laws and partner policies.

• 3.3. Cancellations & Refunds

  • Cancellation and refund policies are clearly mentioned here. You can have detailed look at it.
  • Refunds, if applicable, will be processed within 7 ot 10 days.
  • Duksaa is not responsible for partner-side cancellation policies.

4. User Responsibilities

When using Duksaa, you agree that you will:

• Follow all terms set by the accommodation provider.
• Not damage property or engage in unlawful activities.
• Not misuse or disrupt Duksaa’s platform or services.
• Not impersonate others or provide false information.

Violation of these rules may lead to legal action and account termination.

5. Responsibilities & Liabilities

• 5.1. Duksaa’s Role

  • Duksaa acts as a booking facilitator and is not responsible for accommodation management.
  • We do not own, operate, or control the properties listed on our platform.

• 5.2. Limitation of Liability

  • Duksaa is not liable for property conditions, cancellations, delays, overbooking, or disputes between users and partners.
  • We do not guarantee uninterrupted, error-free service.

To the fullest extent permitted by law, Duksaa is not liable for indirect, incidental, or consequential damages arising from service use.

6. Partner Responsibilities

Partners listing accommodations on Duksaa must:

• Provide accurate information about their property.
• Honor confirmed bookings unless in exceptional cases.
• Comply with all applicable local laws.
• Handle guest issues professionally and legally.

Duksaa reserves the right to delist partners who violate terms or receive repeated complaints.

7. Intellectual Property

• All Duksaa branding, website content, and designs are protected under intellectual property laws.
• Users may not copy, distribute, modify, or misuse Duksaa’s content without permission.

8. Privacy & Data Protection

• By using Duksaa, you agree to our Privacy Policy, which outlines how we collect, use, and store your data.
• We do not sell or misuse personal data but may share information with partners to complete bookings.

9. Dispute Resolution

• 9.1. Between Users & Partners

  • Duksaa encourages users and partners to resolve disputes amicably.
  • If unresolved, users may contact Duksaa support, but Duksaa is not liable for partner-related issues.

• 9.2. Governing Law & Jurisdiction

  • These terms are governed by Pakistani laws
  • Any legal disputes shall be resolved in the courts of Pakistan.
